Franchise Terms & Conditions – Big Scoop Cafe

Franchise Grant

Big Scoop Cafe grants the franchisee a non-exclusive right to operate a café under the brand name, using its systems, recipes, menu, and brand identity at an approved location.

Brand Usage

  • The franchisee is permitted to use the Big Scoop Cafe name, logo, and trademarks strictly for business operations.
  • Any misuse, modification, or unauthorized usage of branding is prohibited.
  • The franchisee does not gain ownership rights over the brand.

Franchisee Responsibilities

The franchisee agrees to:

  • Operate the outlet as per brand guidelines, SOPs, and quality standards.
  • Maintain hygiene, service quality, and customer experience at all times.
  • Follow approved menu, pricing structure, and product standards.
  • Ensure trained staff and smooth day-to-day operations.

Investment & Fees

  • Franchisee is responsible for all setup, operational, and running costs of the outlet.
  • Applicable fees may include:
    • Franchise Fee
    • Royalty on revenue
    • Marketing contributions (if applicable)
  • All payments are non-refundable unless stated otherwise.

Training & Support

  • Big Scoop Cafe provides initial training and operational guidance.
  • Ongoing support may include menu updates, marketing direction, and operational assistance.
  • Additional training or visits may be chargeable.

Location & Setup

  • Outlet location must be approved by Big Scoop Cafe.
  • Interior design, layout, equipment, and branding must follow company standards.
  • Any changes require prior approval.

Supply & Product Standards

  • Franchisee must use approved suppliers and ingredients.
  • Product quality and consistency must match brand standards.
  • Unauthorized sourcing may lead to penalties or termination.

Marketing & Promotions

  • All marketing materials, campaigns, and offers must be approved by the brand.
  • Franchisees cannot independently run promotions without consent.
  • Brand-level campaigns may be mandatory.

Compliance & Licenses

Franchisee is responsible for:

  • All licenses (FSSAI, GST, local permits, etc.)
  • Legal compliance and taxation

The brand is not liable for local regulatory issues.

Confidentiality

  • All recipes, processes, pricing models, and business methods are confidential.
  • Sharing or misuse of this information is strictly prohibited.

Non-Compete

During the agreement, the franchisee cannot operate or be involved in competing businesses.

Term & Renewal

  • Franchise agreement is valid for a fixed term of 5 Years.
  • Renewal is subject to:
    • Performance
    • Compliance with brand standards
    • Updated terms at the time of renewal

Quality Control & Audits

  • Big Scoop Cafe reserves the right to:
    • Conduct inspections
    • Review operations and financials
  • Non-compliance may result in penalties or termination.

Liability

  • Franchisee operates as an independent business owner.
  • All operational risks, profits, and losses are borne by the franchisee.

Termination

The franchise may be terminated if:

  • Brand guidelines are violated
  • Payments are delayed
  • Quality standards are not maintained
  • Legal or compliance issues arise

Intellectual Property

All intellectual property including:

  • Recipes
  • Branding
  • Systems

remain the sole property of Big Scoop Cafe.

Changes to Terms

Big Scoop Cafe reserves the right to update terms and operational guidelines to improve brand standards and business performance.
